If U make local server for U and 3-4 Ur friends - NO.
If U make public server U need permissions.
If U make public modpack U need permissions.

Unless you are using a couple of very specific mods, you generally don't need permissions as long as you are only using mods from the Twitch launcher/Curseforge. When a mod is uploaded there, the mod author automatically allows the mod to be used in packs. If you are using other mods, it is recommended to check before publishing it. For private servers, do whatever you deem fun, permissions generally don't apply there.

I'm sorry I should of been more clear it's a private server yes but it's for a small gaming community and we are always looking to increase our numbers through applications

Then the correct way is take mod by mod and search on curse.com and minecraftforum.net autor's pages and check is it for permissions.
90-95 %% of mods can be used in modpack for free.
3-4 %% U need ost direct link to autor's page.
Als mods need ask.
